Terms of Service

Effective date: March 2023

These Terms of Service ("Terms") apply when you use https://learnappdev.in, our project planner at https://app.learnappdev.in, or buy services from LearnAppDev ("we", "us" or "our"). LearnAppDev is an AI-first app and website development studio based in Jaunpur, Uttar Pradesh, India, working since March 2023. By using our website or accepting a proposal, you agree to these Terms.

1. Our services

We design, build and support:

  • Android apps and web apps;
  • business websites;
  • AI-powered apps and features using models such as Claude, ChatGPT and DeepSeek;
  • WhatsApp automation and CRM tools; and
  • maintenance and support for the above.

The exact work for your project is described in your proposal.

2. Using our website and project planner

  • Give us correct and complete information. Your plan and price depend on it.
  • Do not misuse the website, try to break its security, upload harmful files or send false enquiries.
  • Keep your project link and sign-in links private. Anyone who has them can open your project.
  • The project plan made by our planner, with or without AI, is guidance to help us understand your idea. It is not a contract.

3. Proposals and agreement

  • After you choose a plan, you get a proposal with the scope, the fixed price, the timeline and the payment schedule.
  • Our team confirms each proposal before you can accept it. A proposal is valid for 30 days.
  • When you accept a proposal online, these Terms and the accepted proposal together form our agreement. If they conflict, the proposal applies for that project.
  • Work starts after we receive the first payment and the content we need from you.

4. Prices and payment

Our prices are fixed for the scope in your proposal. Payment terms, taxes and third-party costs are explained in our Pricing and Payment Policy. Refunds are covered by our Refund and Cancellation Policy.

5. Your responsibilities

  • Share your content, logo, text, images, logins and feedback on time. Delays on your side move the delivery date.
  • Make sure you have the rights to all content you give us.
  • Review each delivery and tell us about any problem within 7 days.
  • Create and pay for the accounts that must be in your name, such as your Google Play developer account, domain and hosting, unless we agree otherwise in writing.

6. Changes to the scope

Your plan includes the features and the number of revisions listed in your proposal. New features or bigger changes are priced in writing before we start them. We never start extra paid work without your approval.

7. Delivery and acceptance

We deliver your project as described in our Service Delivery Policy. A milestone is accepted when you approve it, or if you do not report a problem within 7 days of delivery.

8. Ownership and intellectual property

  • After you pay in full, you own the custom design and code we create for your project, and we hand over the source code and access you need.
  • We keep the rights to our own tools, templates, libraries and know-how that existed before your project or are not specific to it. You get a permanent licence to use them as part of your project.
  • Open-source components stay under their own licences.
  • We may show your project in our portfolio unless you ask us in writing not to.

9. Third-party services

Your project may use services run by other companies, such as Google Play, the App Store, hosting providers, payment gateways, WhatsApp and AI providers like Anthropic, OpenAI and DeepSeek. Their terms, prices and approval decisions are outside our control. We help you follow their rules, but we cannot guarantee that an app store will approve your app or that a third-party service will stay available or keep the same price.

10. AI features

AI models can make mistakes or give unexpected results. If your project uses AI, you are responsible for checking how its output is used in your business. Fees charged by AI providers for usage are billed separately at actual cost, unless your proposal says otherwise.

11. Support and warranty

Each plan includes free support for the number of days listed in your proposal, starting from handover. During this time we fix bugs in the work we delivered at no extra cost. Support does not cover new features, problems caused by changes made by others, or changes in third-party services. After this period you can choose a monthly maintenance plan.

12. Confidentiality

We keep your business information and project details confidential and use them only to deliver your project. You also agree to keep our proposals and internal tools confidential.

13. Limitation of liability

We work carefully, but to the extent the law allows, our total liability for any claim related to a project is limited to the amount you paid us for that project. We are not liable for indirect losses, such as lost profits, lost data or lost business opportunities.

14. Ending the agreement

You can end a project at any time by telling us in writing. You pay for the work completed until then, and any refund follows our Refund and Cancellation Policy. We may end a project if payments are not made, if these Terms are broken, or if the project becomes unlawful. In that case we deliver the work you have paid for.

15. Trademarks

Claude, ChatGPT, DeepSeek, Google Play, Android, WhatsApp and other names are trademarks of their owners. We use them only to describe the technologies we work with. We are not endorsed by these companies.

16. Governing law and disputes

These Terms are governed by the laws of India. We will first try to solve any dispute by talking with you. If that does not work, the courts at Jaunpur, Uttar Pradesh, have exclusive jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. The version on our website applies to new proposals. Accepted proposals keep the Terms that applied when you accepted them.
